Terms and Conditions for Use of Card and System |

- These terms and conditions govern the use of the tax free shopping card issued by Ushop Tax Free Limited. By applying for membership of this tax free shopping scheme, you are agreeing to be bound by these terms and conditions.
- You must be resident of a non -European Union (EU) country in order to be eligible to apply for membership and to have a tax free shopping card issued to you.
- If you are an EU resident who is permanently domiciled in a non- EU country, you may apply for membership if you do not intend to return to live, work, or study in any EU country for a minimum period of twelve months after the month in which you make any qualifying purchases.
- Tax Free shopping Cards issued by Ushop Tax Free Limited remain the property of Ushop Tax Free Limited at all times and must be returned on request.
- You must not use your card for any illegal purpose or allow anyone else to do so. If you do, you will be responsible for such use and may be required to reimburse us for all amounts which we incur as a result of such use.
- Tax Free shopping Cards issued by Ushop Tax Free Limited are only valid for tax free shopping with retailers who are operating the Retail Export Scheme under the Smartax Network.
- It is your responsibility to ensure that you are departing from a location with an appointed refund agent. If you are not, you must ensure that you have obtained a printed refund form which must be presented to customs for stamping.
- Tax free shopping cards are only valid for use by the registered user. You may not allow any other persons to make purchases on your behalf or use your card for any reason whatsoever. You must make all purchases in person at participating retailers.
- Goods for which a refund of VAT is being made must be exported from the EU within the three months immediately following the month in which they were purchased. Refunds of VAT cannot be made after this period under any circumstances.
- You must present all goods for which you are claiming a refund of VAT, together with the original sales receipts, to Customs immediately before departure from the EU. No facility exists to claim a refund after the goods have left the EU.
- If you do not export any of the goods purchased under the Retail Export Scheme, you must inform the Customs authorities prior to making a claim for refund of VAT.
- If you return any goods for refund to the retailer, you must present your tax free shopping card at the same time.
- You must take all reasonable precautions to prevent your Card from being used fraudulently. These include:
- signing the Card as soon as it is received and complying with any security instructions;
- taking care of the Card ;
- not allowing anyone else to have or use the Card;
- not tampering with the Card.
- Contacting us about any issue arising from the use of the Card.
- If the Card is lost, stolen or liable to be misused for any reason, you must tell us immediately. We may ask you to confirm it in writing to us.
- You must co-operate with us and the police to recover lost or stolen Cards, and to investigate any unauthorised transactions. If you are asked to report unauthorised transactions to the police, you must do so immediately and in any event within 7 days of being asked. If you recover the Card you must not use it and should cut it in half and return it to us.
- If a third party uses the Card you will be liable for any use that takes place before you notify us under Clause 15 even if you have not authorised it.
- Any miss-use or non adherence to any of these terms and conditions will result in the tax free shopping card being withdrawn, and you will not be able to reclaim your refund. In addition, you may also be liable to legal sanctions under EU legislation.
- We may, at our discretion, change any of the terms of this Agreement or introduce new terms where there is any change to legislation governing the VAT Retail Scheme or where it is otherwise reasonably necessary.
- We may cancel or suspend the use of the Card for all or any purposes or refuse to replace or reissue the Card if:
- a. there is a breach of these terms and conditions of use;
- b. we have reasonable grounds for suspecting that you a or third party has committed or is about to commit a crime or other abuse in connection with the use of the Card ;
- c. you die;
- d. you are bankrupt or have similar proceedings taken against you; or
- e. any information you gave us when you applied for the Card is found to be untrue or where we have reasonable grounds for suspecting this.
- This Agreement will also end when either of us gives notice in writing to the other and, where you end this Agreement, when you return all Cards.
- If this Agreement ends you must ensure there is no further use of the Card.
- On your death, the obligations under these terms and conditions will continue until all Cards have been cut in half and returned to us.
- We may at any time transfer our rights and/or obligations under these terms and conditions to someone else. If we do this, it will not affect your rights and/or obligations. You may not transfer any of your rights and/or obligations.
- We may, at our discretion, relax any of the terms of these terms and conditions but we shall still be entitled to strictly enforce them again at any time.
- If you have a dispute with a third party over a transaction made with your Card, you must notify us immediately.
- We will not be liable to you for any loss due to any failure or delay in providing our service caused by strikes, industrial action, failure of power supplies or computer equipment or other causes beyond our reasonable control.
- This Agreement is governed by English law and we and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
- We are required by law to tell you that the terms of this Agreement are in English and that we will communicate with you at all times in English.
You must notify us immediately if you change any of your name, address, telephone number your e-mail address or any other information relevant to our service. |
